Terms of Service for the School Check-In App

Please read these Terms of Service ("Terms") carefully before using the School Check-In App (the "Service") operated by School Check-In Solutions LLC ("we," "us," or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By using the Service, you agree to be bound by these Terms.
1. Definitions
- “School” refers to the educational institution that licenses our Service for their use.
- “User” or “you” refers to an adult parent, guardian, or other individual authorized by a School to use the Service.
- “Pickup ID” refers to the unique identifier issued by the School and linked to a student for dismissal purposes.
2. The Service
The Service is a web application designed to help Schools manage their student pickup process. It allows authorized Users to notify school staff of their arrival at a designated pickup location to facilitate a more efficient and secure dismissal.
3. User Accounts and Responsibilities
- You must be authorized by a School to create and use an account.
- You are responsible for safeguarding your password and for all activities that occur under your account.
- You agree to notify us immediately through the support channels provided in the app or by emailing support@schoolcheckinapp.com of any suspected unauthorized use of your account.
4. Safety and Responsible Use
Safe Driving is Your Responsibility. You agree that you will not, under any circumstances, use the Service in a way that distracts you from driving or that violates any traffic or safety laws.
- You must assess whether it is safe to interact with the app.
- **Do not interact with the app while your vehicle is in motion.** Park in a safe, legal location before using the check-in feature.
- You must comply with all applicable laws regarding the use of handheld devices while driving.
- School Check-In Solutions LLC expressly disclaims any and all liability for property damage, personal injury, or death that may result from your use of the Service in violation of these terms or applicable law.
5. Acceptable Use
You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to, attempting to:
- Use the Service for any unlawful purpose.
- Impersonate any person or entity.
- Probe, scan, or test the vulnerability of our systems.
- Interfere with or disrupt the operation of the Service.
- Transmit any virus or other malicious code.
- Reverse-engineer or attempt to extract the source code of the Service.
6. Sharing Access
- If you grant pickup access to another individual, **you are solely responsible for that decision.**
- By granting access, you represent and warrant that you have the legal authority to do so, and you agree to indemnify us against any claim arising from an improper grant of access.
- You are responsible for revoking access when it is no longer appropriate. We are not liable for any actions taken by individuals to whom you have granted access.
7. Location Services & Data Handling
The check-in feature requires access to your device's location to verify your proximity to the school. How we handle this and all other personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. The accuracy of location data depends on your device and network conditions, and we cannot guarantee its precision.
8. Termination
We may terminate or suspend your account immediately, without notice, if you breach these Terms. Your right to access the Service is also contingent on your School's active service agreement with us. If your School's agreement terminates, your access will terminate as well.
Provisions of these Terms that by their nature should survive termination will do so, including ownership, disclaimers, indemnity, and limitations of liability.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
WE DO NOT GUARANTEE SPECIFIC PICKUP TIMES OR THAT THE SERVICE WILL ELIMINATE ALL WAIT TIMES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCHOOL CHECK-IN SOLUTIONS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100.00).
10. Indemnification
You agree to defend, indemnify, and hold harmless School Check-In Solutions LLC from any and all claims, damages, and expenses (including attorneys' fees) arising from your use of the Service or your breach of these Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of **Washington**, United States. Any dispute arising from these Terms will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), and you agree to waive any right to participate in a class-action lawsuit. You may opt out of this arbitration provision within 30 days of first use by emailing legal@schoolcheckinapp.com.
12. Changes to These Terms
We may modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice (e.g., via email or an in-app banner) before the new terms take effect. By continuing to use the Service after the changes become effective, you agree to be bound by the revised terms.
